Acceptance of Terms
By accessing or using the website at www.nationalcitydeckandfence.com (the "Site"), or by engaging National City Deck & Fence ("we," "our," or "us") for any services, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the Site or our services.
We may update these Terms from time to time. The most current version will always be posted on this page with an updated Effective Date. Continued use of the Site or our services after an update constitutes acceptance of the revised Terms.
Description of Services
National City Deck & Fence provides residential outdoor construction services including, but not limited to, deck design and construction, fence installation, pergola installation, covered patios, deck repair, and related work. Services are delivered by appointment and are subject to availability, permit requirements, and project-specific conditions.
All services are performed in accordance with applicable building codes and permitting requirements in National City, CA and surrounding jurisdictions. Service availability may vary by location. Contact us to confirm service in your area.
Estimates and Pricing
Written estimates are provided at no charge following an on-site consultation. An estimate reflects the scope, materials, and expected labor cost based on the information available at the time of the site visit. Estimates are valid for 30 days from the date issued unless otherwise stated in writing.
Prices may change if site conditions, material costs, or project scope change after an estimate is issued. Any changes to the original scope will be documented in a written change order and require your approval before additional work proceeds. We will not perform work beyond the agreed scope without first notifying you and obtaining written authorization.
Scheduling and Cancellation
Project start dates are scheduled based on permit approval status and crew availability. We will provide you with a projected start date and notify you promptly if that date changes due to permitting delays, weather, or other factors outside our control.
If you need to cancel or postpone a scheduled project, please notify us as soon as possible. Cancellations made after a deposit has been paid and materials have been ordered may result in forfeiture of some or all of the deposit to cover material and permitting costs already incurred. Specific cancellation terms will be outlined in your project contract.
Payment Terms
Payment terms are specified in your individual project contract. A deposit is typically required before work begins, with the remaining balance due upon project completion and your sign-off. We accept payment by check, bank transfer, or other methods listed in your contract.
If payment is not received according to the agreed schedule, we reserve the right to pause work until payment is brought current. Accounts that remain unpaid beyond the due date specified in the contract may be subject to a late fee as outlined in the contract. Disputes about charges must be raised in writing within 10 days of the invoice date.
Permits and Compliance
Where required by local ordinance, we will apply for and manage the building permit process on your behalf. Permit fees are typically billed as a pass-through cost and are itemized in your written estimate. You are responsible for ensuring that your property is accessible to inspectors during required inspection windows.
If a project is halted or modified because your property has existing unpermitted structures or conditions that require remediation, additional costs may apply. We will notify you in writing before proceeding with any remediation work.
Warranty
We stand behind our workmanship. The specific warranty period and scope for your project will be stated in your written contract. In general, our workmanship warranty covers defects in labor and installation for the period specified. It does not cover normal wear and tear, damage caused by misuse or neglect, damage from weather events beyond normal conditions, or issues arising from materials you supply.
Material warranties, if any, are provided by the respective manufacturer and are separate from our workmanship warranty. We will provide you with manufacturer documentation for any materials that carry a separate warranty.
EXCEPT FOR THE WORKMANSHIP WARRANTY DESCRIBED IN YOUR CONTRACT, ALL SERVICES ARE PROVIDED "AS IS." WE DISCLAIM ALL IMPLIED WARRANTIES TO THE FULLEST EXTENT PERMITTED BY LAW.
Limitation of Liability
To the fullest extent permitted under California law, National City Deck & Fence shall not be liable for any indirect, incidental, special, punitive, or consequential damages arising from or related to our services or this Site, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from services rendered shall not exceed the total amount you paid us for the specific project giving rise to the claim.

The content on this Site - including text, images, and other materials - is provided for informational purposes only. We make reasonable efforts to keep information accurate and current, but we make no guarantees about completeness or accuracy. You may not copy, reproduce, or redistribute Site content without our written permission.
We are not responsible for the content of any third-party websites linked from our Site. Links are provided for convenience and do not imply endorsement.
Dispute Resolution
If a dispute arises out of or relates to these Terms or any services we provide, both parties agree to first attempt to resolve the dispute directly by contacting us in writing at the address below. If the dispute is not resolved within 30 days, both parties agree to participate in good-faith mediation before pursuing any other legal remedy.
Nothing in this section prevents either party from seeking emergency injunctive relief where appropriate.
Governing Law
These Terms and any disputes arising from them are governed by the laws of the State of California, without regard to its conflict of law provisions. Any legal proceedings shall be brought in a court of competent jurisdiction in California.
